Bharat Zones Ltd's SEZ has already been notified. Later it wants to include a neighbouring parcel of land as part of the same SEZ. Under section 4 of the SEZ Act, 2005, what is the position?

The Central Government may, after notifying the SEZ and if it considers it appropriate, notify an additional area as part of that same SEZ. The Developer cannot add land by its own declaration, and the Act does not prohibit additions.

  1. AThe Central Government may, if it considers appropriate, notify the additional area as part of that SEZCorrect
  2. BThe Developer may add the area on its own by filing a declaration
  3. CThe Board alone may add it without any notification
  4. DNo additional area can ever be added after notification

Explanation

The second proviso to section 4(1) lets the Central Government, after notifying an SEZ, notify subsequently any additional area to be included as part of it if it considers appropriate. The Developer cannot self-add land. The Act does not bar additions.
