Cyber security concerns about a spreading malware strain lead the Central Government to want a government agency to monitor and collect traffic data from computer resources across the country. Under Section 69B of the IT Act, 2000, how must the agency be empowered?
The agency must be authorised by the Central Government through a notification in the Official Gazette. Section 69B(1) gives this power for enhancing cyber security and for identifying, analysing and preventing intrusion or the spread of computer contaminant. Companies, intermediaries and State Legislatures cannot grant it.
- ABy a notification in the Official Gazette issued by the Central GovernmentCorrect
- BBy a written order of the board of directors of the affected company
- CBy a direction of the intermediary holding the data
- DBy a resolution of the State Legislature
Explanation
Section 69B(1) says the Central Government may, by notification in the Official Gazette, authorise any agency of the Government to monitor and collect traffic data. A company board, an intermediary or a State Legislature has no role in granting this authorisation.
