For reverse charge supply of goods, if the time of supply cannot be determined under the receipt, payment or thirty-day invoice criteria, what does section 12(3) provide?
Where none of the three reverse charge criteria can be applied to goods, the time of supply is the date of entry in the recipient's books of account, as provided in the proviso to section 12(3).
- AThe date of entry in the books of account of the recipient of supplyCorrect
- BThe date on which the supplier receives payment
- CThe last date for issuing the invoice under section 31
- DThe date of redemption of voucher
Explanation
The proviso to section 12(3) states that where the time of supply cannot be determined under clause (a), (b) or (c), it is the date of entry in the recipient's books of account. Supplier payment and invoice-issue dates relate to forward charge under section 12(2).
