Meera, a novelist, agrees in writing to assign the copyright in a novel she has not yet begun to write to a publisher. When does the assignment take effect?
The assignment takes effect when the work comes into existence. The Act allows a prospective owner to assign copyright in a future work, but the assignment operates only once the work is actually created, not at signing, publication or registration.

Explanation
Under the Act, the owner of copyright in an existing work or the prospective owner in a future work may assign it. For a future work, the assignment takes effect only when the work comes into existence. Signing the agreement alone does not transfer the copyright.
