CS Executive · Setting Up of Business, Industrial and Labour Laws · The Occupational Safety, Health and Working Conditions Code, 2020

Meera Constructions Ltd. runs a building site in Chennai. A worker developed an occupational disease and then left the job. Under the OSH Code's standards on medical examination, what is the position?

Medical examination can continue after the worker leaves the job. The standards must provide for examination and reporting of occupational diseases even after employment ceases, where the disease arises out of or in the course of employment. So ceasing employment does not end this entitlement.

  1. AExamination ends the moment the worker ceases employment
  2. BExamination may be extended even after he ceases to be in employment, if the disease arose out of or in the course of employmentCorrect
  3. CExamination applies only to mine workers, not construction workers
  4. DExamination is available only if the worker pays the cost himself

Explanation

Section 18(2)(c) provides that medical examination, including criteria for detection and reporting of occupational diseases, is to be extended to the employee even after he ceases to be in employment if he suffers from an occupational disease arising out of or in the course of employment. Ending at exit is therefore wrong.
