Meera Engineering Pvt Ltd in Pune is already registered under an existing Central labour law. It asks whether it must obtain a fresh registration under the Code on Social Security, 2020. What is the position under Section 3 of that Code?

Meera Engineering need not register again. Under Section 3 of the Code on Social Security, 2020, an establishment already registered under any other Central labour law in force has that registration treated as deemed registration for the Code, avoiding duplicate registration.

  1. AIt must obtain a fresh registration within one month in all cases
  2. BIt need not register again, and the existing registration is deemed registration for the CodeCorrect
  3. CIt may register only after surrendering the old registration
  4. DIt is exempt from the Code altogether

Explanation

The proviso to Section 3(1) says an establishment already registered under any other Central labour law in force is not required to register again, and that registration is deemed registration for the Code. This reduces duplicate compliance, a key aim of codification. Requiring fresh registration would defeat that aim.
