Meera promises to pay Anil Rs. 2,00,000 if Anil marries Sunita. Before any marriage between them, Sunita dies. Applying Section 32 of the Indian Contract Act, 1872, what is the effect on Meera's promise?

The contract becomes void. Under Section 32, a contract contingent on an event happening becomes void when that event becomes impossible. Sunita's death makes the marriage between her and Anil impossible, so Meera's promise cannot be enforced at all.

  1. AThe contract is enforceable after a reasonable period
  2. BThe contract remains suspended indefinitely
  3. CThe contract is enforceable for half the amount
  4. DThe contract becomes void because the event has become impossibleCorrect

Explanation

Section 32 provides that if the event becomes impossible, the contingent contract becomes void. Sunita's death makes the marriage with Anil impossible, as in the Act's illustration on marriage. Suspension or part enforcement has no basis in the section.
