Meera Textiles Ltd, an Indian company, had a foreign currency transaction during the tax year under the Income-tax Act, 2025. The company's books show a gain from change in exchange rates on a forward exchange contract and on translation of a foreign branch's financial statements. How does the Act treat these gains?

Such gains are treated as income, computed as per the income computation and disclosure standards notified under section 276(2). Section 43 applies to all foreign currency transactions, including monetary and non-monetary items, translation of foreign operations, forward contracts and translation reserves, subject to section 42.

  1. AThey are ignored until the foreign currency is actually remitted to India
  2. BThey are treated as income and computed as per the income computation and disclosure standards notified under section 276(2)Correct
  3. CThey are taxable only for monetary items and not for non-monetary items
  4. DThey are taxable only if the contract is a forward contract and not for translation of foreign operations

Explanation

Section 43(1) treats any gain or loss from changes in foreign exchange rates on foreign currency transactions as income or loss, computed per the notified ICDS. Section 43(2) extends this to monetary and non-monetary items, translation of foreign operations, forward contracts and foreign currency translation reserves. So limiting it to forward contracts or monetary items is wrong.
