Mr. Arjun Mehta, an expert in technology policy with the required years of experience, is proposed as a CCI Member. A shareholder objects that technology is not a listed field of expertise. What is the correct position?

The objection is invalid. Technology was added to the listed fields of expertise by the 2023 amendment, effective 18 May 2023, in both the Member eligibility provision and the Selection Committee expert provision, so a qualified technology expert may be appointed.

  1. AObjection valid; technology was never a listed field
  2. BObjection invalid; technology was inserted as a listed field by the 2023 amendment, effective 18 May 2023Correct
  3. CObjection valid; technology qualifies only for Selection Committee experts, not Members
  4. DObjection invalid; any field is acceptable if the Selection Committee agrees

Explanation

The word technology was inserted into section 8(2) by Act 9 of 2023 effective 18-5-2023, and likewise into the expert field list in section 9. So technology expertise qualifies for Members, subject to fifteen years of experience. Fields are not unlimited, so the last option is wrong.
