CA Final · Indirect Tax Laws · Returns

On scrutiny, the officer informs Manoj Enterprises of discrepancies in its return. Manoj Enterprises accepts the discrepancies but does not correct them in its return. Under section 61, what may the proper officer do?

The officer may initiate appropriate action, including audit, special audit or inspection under sections 65, 66 or 67, or proceed to determine tax and other dues under section 73 or 74. Merely accepting the discrepancy without correcting it in the return for that month does not close the matter.

  1. AInitiate appropriate action including under sections 65, 66 or 67, or determine tax and dues under section 73 or 74Correct
  2. BTake no action because acceptance closes the matter
  3. COnly issue a fresh FORM GSTR-3A notice
  4. DCancel the registration automatically

Explanation

Section 61(3) says that where the person, after accepting the discrepancies, fails to take corrective measure in the return for the month in which the discrepancy is accepted, the officer may initiate appropriate action including under section 65, 66 or 67, or determine tax under section 73 or 74. Acceptance alone does not end the matter.
