CS Executive · Setting Up of Business, Industrial and Labour Laws · Constitution and Labour Laws

Ramesh, a union leader in Pune, argues that Parliament and State Legislatures can both make laws on trade unions and industrial disputes. In which List of the Seventh Schedule of the Constitution do these subjects fall?

Trade unions and industrial and labour disputes fall in the Concurrent List (List III) of the Seventh Schedule. Both Parliament and State Legislatures may legislate on them, with Parliament's law prevailing in case of repugnancy, which is why labour law is shared between the Centre and States.

Explanation

Trade unions, industrial and labour disputes, and social security and employment are entered in the Concurrent List (List III). Hence both Parliament and State Legislatures can legislate, subject to the rule of repugnancy. The Union List does not cover these general labour matters.
