Ravi, a screenwriter, signs a licence on 1 March with Studio Arka for a screenplay he intends to write later. The screenplay is completed on 1 September. From which date does the licence take effect under Section 30 of the Copyright Act, 1957?

The licence takes effect on 1 September, when the screenplay comes into existence. Under the proviso to Section 30 of the Copyright Act, 1957, a licence for a future work operates only once the work exists, not on the date of signing.

  1. A1 March, the date of signing
  2. B1 September, when the work comes into existenceCorrect
  3. CThe date the licence fee is paid
  4. DThe date of registration of the licence

Explanation

The proviso to Section 30 states that a licence relating to copyright in a future work takes effect only when the work comes into existence. The screenplay came into existence on 1 September, so the licence operates from then, not from signing.
