CS Professional · Labour Laws and Practice · The Labour Laws (Simplification of Procedure for Furnishing Returns and Maintaining Registers by Certain Establishments) Act, 1988

Ravi Textiles, a small establishment, maintains its Form II and Form III registers on a computer. An Inspector visits and asks for the registers. What must the employer do under the Act?

The employer must make a printout of the registers, or the relevant portion, available to the Inspector on demand. The Act allows registers to be maintained on a computer or other electronic media, subject to this condition.

  1. ARefuse, since electronic records are not valid
  2. BMake a printout of the registers or the relevant portion available to the Inspector on demandCorrect
  3. CConvert the records to a handwritten register within one year
  4. DGive the Inspector only the annual return in Form I

Explanation

Section 4(2) permits records in physical or electronic form, provided a printout of the returns, registers, books and records, or a portion, is made available to the Inspector on demand. Electronic maintenance is therefore valid, and the Inspector's right to inspect is retained.
