Rohan, a worker from Odisha, is deployed by a contractor at a Pune plant and suffers a fatal accident at work. Under the Occupational Safety, Health and Working Conditions Code, 2020, to whom must the contractor or employer report the accident?

The contractor or employer must report the fatal accident to the specified authorities of both States, the host State and the worker's home State, and also to the worker's next of kin. Reporting to one State alone, or only to family, does not satisfy the Code.

  1. AOnly the specified authority of Maharashtra, where the accident occurred
  2. BOnly the specified authority of Odisha, the worker's home State
  3. CThe specified authorities of both States and the next of kin of the workerCorrect
  4. DThe next of kin alone, since reporting to authorities is optional

Explanation

Section 60(ii) requires that in case of fatal accident or serious bodily injury to an inter-State migrant worker, the contractor or employer reports to the specified authorities of both the States and also the next of kin. Reporting to only one State is incomplete, so options A and B are wrong.
