CS Executive · Setting Up of Business, Industrial and Labour Laws · The Code on Wages, 2019

Sunita is employed on two classes of work, each with a different minimum rate of wages. Under the Code on Wages, 2019, how must her employer pay her?

The employer must pay Sunita, for the time spent on each class of work, wages at not less than the minimum rate in force for that class. Using the lower rate or an average would breach the Code on Wages.

  1. AAt not less than the minimum rate in force for each class, for the time occupied in that classCorrect
  2. BAt the lower of the two minimum rates for the whole period
  3. CAt the average of the two rates for the whole period
  4. DAt the higher rate only for the first class worked each day

Explanation

Section 11 requires the employer to pay for the time occupied in each class of work at not less than the minimum rate in force for that class. Using the lower or an average rate could underpay her for the higher-rated class.
