Swarnim Music Collective, an association of persons, wants to start a business of issuing licences for musical works. To whom does it submit its application for permission under the Copyright Act, 1957, and who decides on registration as a copyright society?

The association applies to the Registrar of Copyrights, who submits the application to the Central Government. The Central Government, not the Registrar, decides whether to register it as a copyright society, having regard to the interests of authors, the public and the applicant's competence.

  1. AIt applies to the Registrar of Copyrights, who submits it to the Central Government; the Central Government decides on registrationCorrect
  2. BIt applies to the Appellate Board, which decides on registration
  3. CIt applies to the Central Government, and the Registrar of Copyrights decides on registration
  4. DIt applies to the Registrar of Copyrights, who alone decides on registration

Explanation

Section 33(2) says the association applies to the Registrar of Copyrights, who submits the application to the Central Government. Under section 33(3), the Central Government may register the association as a copyright society. Options 3 and 4 wrongly give the Registrar the decision.
