The Central Government sends the Board a written direction on a matter and the Board disputes that it is a question of policy. Under the SEZ Act, 2005, who decides whether the question is one of policy, and with what effect?

The Central Government decides, and its decision is final. Section 9(5) binds the Board to written policy directions from the Central Government, and section 9(6) provides that the Central Government's determination of whether a question is one of policy is final.
