CS Executive · Setting Up of Business, Industrial and Labour Laws · Constitution and Labour Laws
The Second National Commission on Labour (2002) examined India's many central labour laws, which differed in definitions and authorities. Which recommendation is most consistent with its approach that led to the Labour Codes?
The Second National Commission on Labour recommended rationalising and consolidating the many central labour laws into a few broad groups: industrial relations, wages, safety and welfare, and social security. This idea of reducing multiplicity of definitions and authorities eventually shaped the four Labour Codes.
- ARetain every existing enactment separately to preserve distinct definitions
- BAbolish all labour legislation and rely only on contracts
- CTransfer all labour matters exclusively to the State List
- DRationalise and consolidate the existing central laws into a few broad groups, such as industrial relations, wages, safety and welfare, and social securityCorrect
Explanation
The Commission recommended grouping the numerous central laws into broad codes covering industrial relations, wages, safety and welfare, and social security, to remove multiplicity of definitions and authorities. This is the basis of the four Labour Codes. Retaining all laws separately, abolishing legislation or moving labour to the State List does not match this approach.
