The Tribunal sanctions a compromise between Kaveri Logistics LLP and its partners on 10 March. By when must the LLP file the order with the Registrar, and from when does the compromise take effect?
The LLP must file the Tribunal's order with the Registrar within thirty days of making it, and the compromise or arrangement takes effect only after it has been filed. Mere sanction by the Tribunal is not enough to make it operative.
- AWithin sixty days; effective from the date of the Tribunal's order
- BWithin thirty days; effective only after it is so filedCorrect
- CWithin thirty days; effective from the date of the Tribunal's order
- DWithin ninety days; effective only after it is so filed
Explanation
Section 60(3) requires filing within thirty days of the order, and the order has effect only after it is filed. The option saying it is effective from the order date ignores the filing condition.
