Under Indian succession practice, which feature of a registered Will distinguishes it from an unregistered Will that is otherwise validly executed?
A registered Will is easier to prove and harder to dispute on authenticity, yet registration is not compulsory for validity. A properly signed and attested unregistered Will is also valid. Registration does not stop revocation, remove the witness requirement, or remove probate rules.
- AIt cannot be revoked or altered by the testator after registration
- BIt is not required to be attested by witnesses
- CIt is easier to prove and less likely to be challenged on authenticity, but registration is not mandatory for validityCorrect
- DIt automatically avoids probate in every Indian state
Explanation
Registration of a Will is optional. A validly executed and attested Will is legally effective even if unregistered. Registration gives strong evidentiary value and a safe custody record, so disputes on authenticity are less likely. A registered Will can still be revoked or changed, and it still needs attesting witnesses.
