Under Section 24 of the FCRA, 2010, an inspecting officer may seize an account or record after inspection. Which condition must be met for seizure?

Seizure is allowed when, after inspecting the account or record, the officer has reasonable cause to believe that a provision of the FCRA or any other law relating to foreign exchange has been or is being contravened. No conviction or cancellation of registration is required beforehand.

  1. AThe officer has reasonable cause to believe that a provision of the Act or of any other law relating to foreign exchange has been or is being contravenedCorrect
  2. BThe person has been convicted by a court of a foreign exchange offence
  3. CThe Central Government has already cancelled the person's certificate of registration
  4. DThe person has failed to file the annual return for two consecutive years

Explanation

Section 24 requires only that, after inspection, the officer has reasonable cause to believe that the Act or another foreign exchange law has been or is being contravened. Prior conviction or cancellation is not a precondition, so those options are wrong.
