Under Section 6, a person is a minor when the period is to be reckoned and, before that disability ceases, becomes insane. Which statement is correct?
He may sue within the same period after both disabilities have ceased. Section 6(2) provides that where a further disability arises before the first has ended, the period is reckoned from the cessation of both.
- AHe may sue within the same period after both disabilities have ceasedCorrect
- BHe may sue within the same period after the first disability ceases, ignoring the later one
- CHe may sue only if the second disability began after the period had expired
- DHe must sue within the original period, as successive disabilities are not recognised
Explanation
Section 6(2) covers a person affected by two disabilities at the relevant time, or by another disability before the first has ceased. The period then runs from the time both disabilities have ceased. The option ignoring the second disability is wrong because the sub-section expressly counts it.
