Under the Bharatiya Sakshya Adhiniyam, 2023, which of the following is expressly excluded from the meaning of "Court"?
Arbitrators are excluded. The definition of Court covers all Judges, Magistrates and persons legally authorised to take evidence, but expressly says except arbitrators, so an arbitrator does not count as a Court under the Adhiniyam.
- AMagistrates
- BArbitratorsCorrect
- CAll Judges
- DPersons legally authorised to take evidence, other than arbitrators
Explanation
The definition of "Court" includes all Judges and Magistrates and all persons legally authorised to take evidence, but it expressly excepts arbitrators. Hence an arbitrator is not a Court for the Adhiniyam. The other options are all included.
