While finalising a lease deed for Meera Textiles Pvt Ltd, the draftsman notices that a rent figure typed in the engrossed copy is wrong, and it has already been signed by both parties but not yet registered. Which course best follows sound drafting and execution practice for the correction?

The wrong figure should be neatly struck through, the correct figure written alongside, and every executing party should initial or sign against the change. This shows that all parties consented to the alteration, whereas concealment or correction by the draftsman alone does not.

  1. AStrike out the figure, write the correct one above it, and have all executing parties initial or sign against the alterationCorrect
  2. BOverwrite the figure with correction fluid and re-sign only the last page
  3. CHave the draftsman alone initial the correction as he prepared the document
  4. DLeave the document as it is and explain the error orally to the registrar

Explanation

A material alteration made after execution should be visible, legible and authenticated by all parties who executed the document, usually by initials or signatures in the margin or near the change. Using fluid hides the original text, and a unilateral initial by the draftsman does not show the parties' consent.
