A Bengaluru software firm develops a computer programme. Which additional right does Section 14(b) give for a computer programme compared with other literary works?
For a computer programme, Section 14(b) adds the exclusive right to sell, give on commercial rental, or offer for sale or commercial rental, any copy, besides the acts for literary works. The rental right does not apply where the programme is not the essential object of the rental.
- AThe right to sell or give on commercial rental, or offer for sale or commercial rental, any copy of the programmeCorrect
- BThe right to reproduce the programme only in printed form
- CThe right to make a translation only into Indian languages
- DThe right to perpetual copyright with no limit of time
Explanation
Section 14(b) gives, for a computer programme, the acts in clause (a) plus the right to sell or give on commercial rental, or offer for sale or rental, any copy. The proviso says commercial rental does not apply where the programme itself is not the essential object of the rental.
