In January, Arjun, a screenwriter, signs a written licence in favour of a studio for the copyright in a script he intends to write later. He completes the script in June. From when does the licence take effect?

The licence takes effect in June, when the script comes into existence. Under the proviso to Section 30, a licence for copyright in a future work operates only once the work exists, so signing earlier, paying royalty or registering does not bring it into effect.

  1. AFrom January, when the licence was signed
  2. BFrom the date the studio pays the first royalty
  3. CFrom June, when the work comes into existenceCorrect
  4. DFrom the date of registration with the Registrar of Copyrights

Explanation

The proviso to Section 30 says a licence relating to copyright in a future work takes effect only when the work comes into existence. Signing in January does not make it effective then. Payment or registration is not the trigger.
