An inspecting officer examines the accounts of an FCRA recipient and has reasonable cause to believe the Act is being contravened. He seizes an account record under Section 24, but no proceeding is brought for the contravention. After how long must the record be returned?

The authorised officer must return the seized account or record to the person from whom it was seized if no proceeding is brought within six months from the date of seizure for the contravention disclosed by that record, as the proviso to Section 24 states.

  1. AWithin thirty days of seizure
  2. BIf no proceeding is brought within six months from the date of seizureCorrect
  3. COnly after the recipient's certificate is cancelled
  4. DNever, once seized

Explanation

The proviso to Section 24 requires the authorised officer to return the seized account or record to the person from whom it was seized if no proceeding is brought within six months from the date of seizure for the contravention disclosed. Thirty days is not the period, and return does not depend on cancellation.
