In a domestic arbitration between Gupta Agro Ltd and Rathi Traders, pleadings under section 23(4) were completed on 1 March 2026. No award was made by 1 March 2027. The parties agreed in writing on 20 February 2027 to extend time by the maximum period they could extend by consent. Assuming no Court order, by which date must the award be made so the tribunal's mandate does not terminate?

The award must be made by 1 September 2027. The twelve months from completion of pleadings ended on 1 March 2027, and parties can extend by consent only up to a further six months. Beyond that the mandate terminates unless the Court extends the period.

Explanation

Under section 29A(1) the award is due within twelve months of completion of pleadings, that is 1 March 2027.
