Neha, a CS, was removed from membership of ICSI for two years after an inquiry found her guilty of professional misconduct. Three months later she applies to have her name re-entered in the Register of members. What is the position?
She is not entitled to re-entry until the two-year period ends. Section 8(f) and its proviso bar a person removed for misconduct, and one removed for a specified period cannot have her name entered in the Register of members until that period expires.
- AShe may be entered immediately because removal is only a penalty
- BShe may be entered after paying the prescribed fee
- CShe is not entitled to entry until the specified period expiresCorrect
- DShe is permanently barred from the Register
Explanation
Section 8(f) disqualifies a person removed from membership after inquiry for misconduct, and its proviso says a person removed for a specified period is not entitled to entry in the Register until that period expires. Permanent bar (option D) applies only where removal is not for a specified period, so it does not fit.
