Rohit has booked a flat in a Bengaluru project and the agreement for sale mentions stage-wise completion milestones. He asks the promoter for the stage-wise time schedule of completion, including water, sanitation and electricity provisions. Under RERA, 2016, what is his position?

Rohit is entitled to know the stage-wise time schedule of completion, including provisions for water, sanitation, electricity and other amenities, as agreed between promoter and allottee in the agreement for sale. The right is individual and does not depend on possession or on any collective request by allottees.

  1. AHe is entitled to know it, as agreed between promoter and allottee under the agreement for saleCorrect
  2. BHe is not entitled, because only the Authority may receive such schedules
  3. CHe is entitled only after taking possession of the flat
  4. DHe is entitled only if two-thirds of allottees jointly request it

Explanation

Section 19(2) entitles the allottee to know the stage-wise time schedule of completion, including water, sanitation, electricity and other amenities, as agreed in the agreement for sale. The two-thirds requirement relates to transfer of the promoter's majority rights under section 15, not to this right.
