CS Executive · Setting Up of Business, Industrial and Labour Laws · The Industrial Relations Code, 2020

Kaveri Engineering has a Grievance Redressal Committee of 10 members, with 5 each from the employer and workers. 30% of its workforce are women. Under the Code, what is the position on women's representation?

Women's representation in the committee must be adequate and not less than their share of the total workforce. With 30% women workers, that means at least three of the ten seats. The Code sets a proportional floor, not an equal-half or single-seat rule.

  1. ARepresentation of women must not be less than their proportion in the total workforceCorrect
  2. BWomen must hold exactly half the seats
  3. CWomen need no representation, as the committee is equally divided between employer and workers
  4. DWomen's representation is fixed at one member regardless of workforce

Explanation

The proviso to section 4(4) requires adequate representation of women workers, not less than the proportion of women workers to total workers. Here 30% of 10 members means at least 3 women. Exact half or a fixed single seat is not what the Code provides.
