CS Executive · Setting Up of Business, Industrial and Labour Laws · The Industrial Relations Code, 2020

Deepak, a worker at Narmada Plastics, files a grievance with the Grievance Redressal Committee on 1 March. The committee fails to resolve it within the period specified in the Code. Deepak is a member of a trade union. What is the correct next step?

Deepak may, within sixty days from the expiry of the committee's thirty-day period, apply for conciliation to the conciliation officer through his trade union. The grievance does not lapse, and the Works Committee is not the route for individual grievance escalation.

  1. AWithin sixty days after that period expires, apply for conciliation to the conciliation officer through his trade unionCorrect
  2. BWithin thirty days, apply directly to the Tribunal
  3. CWithin one year, apply to the Works Committee
  4. DNothing further, as the grievance lapses once unresolved

Explanation

Under section 4(8), a worker whose grievance is not resolved within the thirty-day period may, within sixty days from its expiry, apply for conciliation to the conciliation officer through the trade union of which he is a member. Direct Tribunal access under section 4(10) arises only later, in specified circumstances.
